Attorney General: Global Crisis, Not Local Gouging, Behind Fuel Hike

As gasoline costs climb and shipping surcharges rise, officials warn the economic impact could soon spread far beyond the pump.

KOROR — Attorney General Ernestine K. Rengiil says Palau’s sharp rise in gasoline prices is being driven mainly by the war in Iran and turmoil in global oil markets, and warns that any attempt to prosecute fuel suppliers for price gouging would face significant legal obstacles.

In an April 30 letter to House Speaker Gibson Kanai, Rengiil noted that pump prices in Palau have climbed about 25 percent since March 5, just days after Iran closed the Strait of Hormuz following a joint U.S. and Israeli attack. The Strait carries roughly one‑fifth of the world’s petroleum, and its disruption has pushed benchmark Brent crude from about 71 dollars per barrel in late February to around 100 dollars, with spikes even higher as the conflict escalated.

Palau’s fuel prices are unregulated and closely tied to ex‑Singapore bunker fuel rates, which have soared in response to the crisis. Bunker prices in Singapore have been reported at more than 1,100 dollars per tonne—over 60 percent above Brent itself—driving up costs throughout the Asia‑linked shipping network. A March 29 notice from Triple B Forwarders to customers, attached to the Attorney General’s letter, shows fuel‑related surcharges for Micronesia rising to 31 percent, surcharges the company says are strictly passed through from carriers.

Rengiil warned that higher fuel costs will ripple beyond the gas pump, affecting shipping, electricity generation, and everyday prices across the economy. She cited the Palau Development Plan’s finding that imported diesel and power costs are highly volatile, and said the House of Delegates is “rightfully concerned” about the risk of broader price increases and potential gouging.

At the same time, she cautioned that enforcing Palau’s Anti‑Price Gouging Act of 2022 will not be simple. The law treats war‑related market disruptions as a trigger and allows cases when prices rise more than 25 percent within 30 days, but it also lets suppliers defend themselves by showing increased costs beyond their control. With local prices rising just as the Strait closed and global benchmarks surged, Rengiil believes fuel retailers and importers would argue they are merely passing on international costs, not exploiting the crisis.

“We might be able to make a prima facie case,” she wrote, but questioned whether using limited government resources to prosecute gas stations or their suppliers is the best course when the main drivers of price hikes are overseas. For now, the Attorney General has pledged continued monitoring and cooperation with lawmakers, while signaling a cautious approach to bringing price‑gouging cases in the midst of a global energy shock.
